    Are these diary pages copyrighted? I'm wondering if they can be posted on other websites.

    I noticed at the bottom of the diary pages, right hand side - there is the Copyright sign © Crown copyright - ie. © (a circled capital letter C for copyright)

    I would therefore assume they are copyrighted.

    Yes, the National Archives own the images. You'd have to look on their website to see quite what that means - they might have some kind of fair use thing where you can do what you want with them as long as it's not for profit. Double check, though.

    I'm not a copyright specialist, so don't take my word as gospel. See http://www.nationalarchives.gov.uk/legal/copyright/image-reproduction/ - images do remain copyright. However if you're using one or two for non-commercial purposes fair dealing probably comes into play, so you shouldn't just be using for decoration, but if you're discussing the content etc no-one's likely to get too upset, and as noted on that web page, you can use you're own transcription of any record without issues.

    I've certainly used some on my own blog, eg https://halfmuffled.wordpress.com/2016/12/10/36-casualty-clearing-station-located/wo-95_344_9_plan/ would be impossible to transcribe (as it's a plan), and it's vital to show the location of the CCS. I've not used very hi-res though, or here https://halfmuffled.wordpress.com/2016/07/05/albert-arthur-stoner-1896-7-july-1916/wo-95-2142-1/ I've just taken the smallest snippet of what would cover my point.

    Found a Question re War Diary Copyright

    Answer was: “For any WW1 official war diary held at The National Archives, you are free to use as much as you want in transcription, print or web, as long as you credit its source (TNA and piece number etc.). The only thing that you can't do is use an image of any part of the diary even if you've taken it yourself”.

    Thanks for your replies. I just sent the National Archives an email asking about this, and it said they will reply "within 10 days," so I'll let you know what they say.

    Here's the answer I got from The National Archives:

    1--- If the material you want to re-use is an extract, quote or transcription from a Crown copyright public record, I can confirm that you may do so under the terms of the Open Government Licence (OGL). The OGL is a free licence which takes the form of a simple set of terms and conditions. You should include the document reference number and acknowledge The National Archives as holder of the document.

    2--- If your request relates to the re-use of an image of a public record held at The National Archives, you should contact our Image Library at: image-library@nationalarchives.gsi.gov.uk or write to: Image Library, The National Archives, Kew, Richmond , Surrey TW9 4DU or telephone: +44 (0)20 8392 5225.

    I sent my question to that Image Lilbrary email address, and here's their reply:

    The reproduction of images of the documents themselves on an open website in perpetuity constitutes worldwide publication, and costs a one-off fee of £40.00 + £8.00 VAT. This fee covers the upload of between one and twenty TNA document images.
    The images must be protected from unauthorized download at high resolution by a third party. You can do this by watermarking, or by keeping the resolution to a level whereby the documents are legible for information and research, but are not of sufficient quality for commercial publication.

    So, you can post an extract free as long as you credit The National Archives as the source, but if you want to post the image of an entire page, you have to pay them.

    I thought it'd be something like that. It's one of the reasons we can't go back through the diaries after tagging them.
